Terms of Use

Last updated: September 22, 2026

The short version
  • Alba is a monthly subscription that organizes and helps answer your business WhatsApp. Cancel anytime, no contract.
  • You keep ownership of your data and your customers' messages, and you are responsible for using WhatsApp within Meta's rules and the law.
  • AI can make mistakes. Suggestions are suggestions, and you decide what gets sent.
  • Payments go through Stripe and renew automatically each month until you cancel.

1. The agreement

These Terms of Use are an agreement between you and Alba ("Alba", "we", "us"), a service based in Ontario, Canada, available at heyalba.app. By creating an account or using Alba, you accept these Terms and our Privacy Policy. If you accept on behalf of a business, you confirm you are allowed to bind that business, and "you" means the business.

2. The service

Alba connects to your WhatsApp Business number through Meta's official WhatsApp Business Platform. Depending on your plan it can rank conversations by priority (S to D), summarize them, transcribe voice messages, suggest and send replies, remind you of customers waiting for an answer, manage appointments, show statistics and send data to your own system. Features may evolve over time; we will not remove a core feature of a paid plan without telling you in advance.

3. Your account

4. WhatsApp and your customers

5. Artificial intelligence

Priorities, summaries, transcripts and suggested replies are produced by AI and can be incomplete or wrong. Review important information before acting on it. Alba does not give legal, medical, financial or other professional advice, and you remain responsible for the messages sent to your customers from your number, including those you approve or allow Alba to send.

6. Plans, billing and cancellation

7. Your data

You own your content, including your customers' messages and the information Alba produces for you. You give us permission to process it only to provide, secure and support the service, as described in our Privacy Policy. We do not sell it and we do not use it to train AI models. You can ask for an export or deletion at any time.

8. Acceptable use

You agree not to: break the law or anyone's rights; try to access other accounts or our systems without permission; reverse engineer, copy or resell Alba; overload the service or bypass its limits; or use Alba to build a competing product.

9. Our property

Alba, its software, design, name and logo belong to us. These Terms give you a limited, non exclusive, non transferable right to use Alba while your subscription is active. If you send us suggestions, we may use them freely.

10. Third party services

Alba depends on services we do not control, such as Meta (WhatsApp), Stripe, Google and our AI and hosting providers. Their terms also apply to your use of them, and we are not responsible for their outages, changes or decisions.

11. Availability and changes

We work to keep Alba available and secure, but we do not guarantee it will be uninterrupted or error free. We may perform maintenance and improve or change the service. If we ever discontinue Alba, we will give at least 30 days' notice and refund any prepaid period not used.

12. Suspension and termination

We may suspend or close an account that breaks these Terms, puts other users or Alba at risk, or is required to be closed by law or by Meta. When possible, we will warn you first and give you a chance to fix the problem. You can close your account anytime. After closing, we delete your data as described in the Privacy Policy.

13. Disclaimer and limitation of liability

Alba is provided "as is". To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, lost profits, lost sales or lost data, and our total liability for any claim related to Alba is limited to the amount you paid us in the 3 months before the event that gave rise to the claim. Nothing in these Terms limits rights that cannot be limited under the law that applies to you.

14. Indemnity

You agree to cover reasonable losses and costs we incur because of claims from third parties, including your customers or Meta, arising from your content or from your breach of these Terms or of the law.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be resolved in the courts of Ontario, unless the law of your place of residence gives you the right to go to your local courts.

16. Changes to these Terms

We may update these Terms. If a change is significant, we will tell you by email or in the dashboard at least 15 days before it takes effect. If you do not agree, you can cancel before then.
